1. These terms of use are issued by Go Native Ltd, Company No. 3479011, whose registered office is at United House, 9 Pembridge Road, London, W11 3JY (“the Company”, “we”, “us” or “our”).
2. These terms apply to the entire contents of the Website under the domain names www.gonative.com and/or www.gonative.co.uk (“the Website”).
3. Certain areas of the Website are only available to registered users.
4. By accessing any part of the Website you agree to be bound by these terms, which shall take effect immediately on your first use of the Website, regardless of whether or not you choose to register with us. If you do not agree to be bound by all of these terms, please do not access, use and/or contribute to the Website.
5. The Company may revise these terms at any time without notice. You should check the Website from time to time to review these terms. If you do not agree to the changes, you should cease using the Website. If there is any conflict between these terms and specific local terms appearing elsewhere on www.gonative.com and/or www.gonative.co.uk then the latter shall prevail.



6. The copyright and other intellectual property rights in all material on the Website (registered and unregistered) are owned by the Company or its licensors. Your access to the material and products or services available through the Website does not give you a license to modify, display, license, transfer, sell, reproduce, distribute or otherwise use any material (including data) except for your own personal, non-commercial use.

Any other use of www.gonative.com and/or www.gonative.co.uk content requires the prior written permission of Go Native Ltd.



8. Other than personally identifiable information, which is covered by our Privacy Policy, any material you transmit or post to the Website shall be considered non-confidential and non-proprietary. The Company and its designees shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other data embodied therein for any and all commercial or non-commercial purposes.
9. You are prohibited from posting or transmitting to or from the Website any material:

  1. that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;
  2. for which you have not obtained all necessary licences and/or approvals;

10. The Company shall fully co-operate with any law enforcement authorities or court order requesting or directing the Company to disclose the identity or locate anyone posting any material in breach of clause 9.
11. The Website contains robot exclusion headers. Third parties may licence information on the Website to the Company. You agree that you will not use any robot, spider, scraper or other automated means to access the website for any purpose without our express permission. Additionally you agree that you will not:

  1. take any action that imposes, or may impose in our sole discretion a disproportionately large load on our infrastructure;
  2. copy, reproduce, modify, distribute or publicly display any content (except for your information) from the Website without the prior written consent of the Company or appropriate third party, as applicable;
  3. interfere or attempt to interfere with the proper working of the Website or any activities conducted on the Website;
  4. bypass robot exclusion headers or any other measures we may use to prevent or restrict access to the Website.
12. You agree to use any message board or online community in accordance with the following rules:

  1. All contributions must be civil and in good taste;
  2. Offensive or vulgar language or abusive or threatening behaviour is prohibited;
  3. You must not post any unlawful or objectionable content including but not limited to material which is sexist, racist, homophobic, obscene, pornographic or defamatory;
  4. You must not refer to operator website addresses without the permission of the Company.
  5. For your own personal safety and security you must not reveal any personal information about yourself or anyone else (for example telephone or mobile number, or home address) in postings.
  6. We reserve the right to delete any contribution at our sole discretion at anytime and without notice.
  7. We do not endorse the content of any materials submitted by a user to any message board(s) on the Website.
  8. If you are found to be in violation of any part of these terms your ability to use any or all of the services on the Website may be permanently or temporarily rescinded.
  9. You confirm to us that you are at least 18 years of age and possess the legal authority to enter into this agreement.



13. This site may contain hyperlinks to sites operated by parties other than Go Native Ltd. These links are provided for reference only. Go Native Ltd does not control them and is not responsible for their content or your use of them. Inclusion of hyperlinks to external sites does not imply any endorsement of any material on such sites or any association with their operators.
14. If you wish to create a link to the Website you must contact us by emailing enquiries@gonative.com to seek permission to do so. If permission is granted, you may create a link to the Website on the basis that you do not replicate the home page of the Website, providing that:

  1. you do not remove, distort or otherwise alter the size or appearance of our logo, trademark or trade name;
  2. you do not create a frame or any other browser or border environment around the Website;
  3. you do not in any way imply that the Company is endorsing any products or services other than its own;
  4. you do not misrepresent your relationship with Go Native nor present any false information about the Company;
  5. you do not otherwise use any logo, trade mark or trade name displayed on the Website without express written permission from the Company;
  6. you do not link from a website that is not owned by you; and
  7. your website does not contain content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.



15. If you register with the Website, each registration is for a single user only. The Company does not permit you to share your user name and/or password with any other person nor with multiple users on a network.
16. Responsibility for the security of any passwords chosen or issued to you rests with you. We reserve the right to disable any user names or passwords at any time if you fail to comply with any of the provisions of these terms.



17. While the Company endeavours to ensure that the information on the Website is correct, the Company does not warrant the accuracy and completeness of the material on the Website. The Company may make changes to the material on the Website, or to the products services and/or prices described in it, at any time and without notice.
18. While the Company endeavours to ensure that the Website is available 24 hours a day, the Company shall not be liable if for any reason the Website is unavailable at any time or for any period.
19. The material on the Website is provided “as is” and on an “as available” basis, without any conditions, warranties or representations of any kind. Accordingly, to the maximum extent permitted by law, the Company provides you with the Website on the basis that the Company excludes all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).

Subject to clause 20, Go Native Ltd shall not be liable for any of the following losses or damage, whether such damage or losses were foreseen, foreseeable, known or otherwise: loss of data; loss of revenue or anticipated profits; loss of business; loss of opportunity; loss of goodwill or injury to reputation; losses suffered by third parties; any indirect, consequential, special or exemplary damages arising from the use of www.gonative.com and/or www.gonative.co.uk regardless of the form of action.
22. Go Native Ltd do not warrant that functions available on the Website will be uninterrupted or error free, that defects will be corrected, or that www.gonative.com and/or www.gonative.co.uk or the server(s) that makes the Website available are free from viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
23. If your use of the Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.



24. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and the remaining terms shall survive and continue to be binding and enforceable.
25. The failure or delay of Go Native Ltd to exercise or enforce any right in these terms does not waive our right to enforce that right.
26. This legal notice shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
